This section summarizes all important information about our terms and conditions. These regulations apply when the contract is concluded, i.e., when the booking for the schwarzwaldschick Feldberg vacation apartment is confirmed.

1. Conclusion of contract:

Booking requests can be made via the booking enquiry form or in writing by email to ferienwohnung-schwarzwaldschick@web.de. If the desired dates are available, you will receive written confirmation of the booked holiday apartment and a list of all costs from us. The reservation for the holiday apartment is legally binding upon receipt of the booking confirmation or after payment of the deposit.

2. Withdrawal from the contract/cancellation:

In general, a 30-day free cancellation period applies, i.e. up to 30 days before arrival, the stay can be canceled free of charge in writing by email or telephone. If you cancel within 30 days to 4 days before arrival, you will be refunded the booking amount minus the deposit. For cancellations made less than 4 days before check-in, you will pay 80% and receive a refund of 20% of the booking amount. I strongly recommend taking out private travel cancellation insurance! Background: A positive coronavirus test or coronavirus infection of a travel participant is no longer considered an exceptional circumstance and does not justify free cancellation of the trip.

3. Payment:

For a binding booking, the deposit specified in the booking confirmation must be paid by bank transfer within one week of receipt of the booking confirmation. The remaining amount must be paid by bank transfer at least one month before departure. If the booking is made at short notice, less than 30 days before arrival, the full amount must be paid immediately by bank transfer. A deposit may be charged on site.

4. Arrival and departure:

The vacation apartment is normally available from 3 p.m. on the day of arrival and until 10 a.m. on the day of departure. Deviations from this are only possible after consultation with the landlord and/or property manager. On the day of departure, the vacation apartment must be left in a clean and tidy condition with the trash cans emptied (no final cleaning) and all keys must be returned to the property manager.

5. Stay:

The vacation rental is only made available for the number of people agreed in the contract (see booking confirmation). Subsequent changes require the written permission of the landlord. In the event of violations, the landlord is entitled to terminate the rental agreement without notice.

6. Obligations of the tenant:

The vacation apartment will be handed over by the landlord in a neat and clean condition with a complete inventory. Should any defects or damage exist or occur during the rental period, we ask the tenant to inform us immediately. The tenant is liable for any damage caused by them to the rental property or the inventory, e.g., broken crockery, damage to the floor or furniture. This also includes the cost of lost keys. Complaints that are only received by us at the end of the stay or after the tenant has left the vacation apartment are excluded from any claims for damages.

7. Pets:

Pets, especially dogs, are not allowed. The Schwarzwaldschick is a pet-free apartment.

8. Smoking & events:

Smoking is prohibited in the apartment, and events and parties are not allowed.

9. COVID-19 measures:

Please inform yourself about the currently valid Corona rules (see booking confirmation) and observe them.

10. Statute of limitations:

Claims of the guest against the landlord generally expire one year after the start of the statutory limitation period (§199 (1) BGB). This does not affect claims by the guest arising from injury to life, limb, or health, as well as other claims based on intentional or grossly negligent breach of duty by the landlord, a legal representative, or vicarious agent.

11. Choice of law and place of jurisdiction:

German law applies. The place of jurisdiction for legal action taken by the guest against the landlord is exclusively the landlord's registered office. For legal actions brought by the lessor against merchants, legal entities under public or private law who do not have a general place of jurisdiction in Germany or who have moved their place of residence or habitual abode abroad after conclusion of the contract or whose place of residence or habitual abode is unknown at the time the action is brought, the registered office of the lessor is agreed as the exclusive place of jurisdiction.

12. Severability clause:

Should one or more provisions of these General Terms and Conditions become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose pursued by the invalid provision.
